About these terms
These terms are an agreement between you and Radicio Realis S.L., CIF B56886690, which operates PeakTock. By downloading, installing, using or purchasing PeakTock, you agree to these terms. If you use PeakTock for a business, you confirm that you are authorised to accept these terms for that business.
Fourteen-day free trial
The trial lasts 14 days from first launch and includes all app features. No payment card is required to start it. When the trial ends, PeakTock requires a valid paid licence to continue using the app.
Early-bird lifetime licence
Price: USD $20 as a one-time early-bird purchase.
Use: one person on one Mac at a time.
Updates: all future PeakTock updates are included for early-bird purchasers.
We may change or end the early-bird offer for future purchasers. A change to the offer will not remove the licence or included updates already purchased under these terms. The licence is personal, non-exclusive, non-transferable and may not be shared, resold or used simultaneously on multiple Macs.
Payments, taxes and delivery
Creem acts as Merchant of Record for PeakTock purchases. Creem processes payment, calculates and collects applicable taxes, issues the receipt and sends the licence key to the email address used at checkout. The checkout shows the final amount and any applicable tax before you pay.
You are responsible for providing a working email address and keeping your licence key secure. If you lose access to the key or need to replace your activated Mac, contact [email protected].
Evaluate before purchasing
PeakTock provides the full-featured 14-day free trial described above so you can evaluate the app before purchasing. We do not offer a separate voluntary money-back guarantee after purchase. This does not limit mandatory consumer rights, including remedies that may apply if digital content is faulty or not as described. Contact [email protected] with any purchase problem or request based on those rights. Any refund that is required by applicable law is processed through Creem to the original payment method.
Acceptable use
You must not:
- share, sell, rent, sublicense or distribute your licence key;
- circumvent the trial, licence checks or one-Mac activation limit;
- reverse engineer or modify PeakTock except where applicable law expressly permits it;
- use PeakTock in a way that violates law or another person's rights; or
- interfere with the website, licensing service or other users.
We may suspend a licence where reasonably necessary to investigate fraud, key sharing, abuse or a material breach of these terms. We will restore it if the issue is resolved in your favour.
Software and intellectual property
PeakTock and its software, design, branding and content are protected by intellectual property laws. Your purchase gives you only the right to use the software under these terms; it does not transfer ownership of PeakTock or its underlying materials. Feedback may be used to improve the product without an obligation to compensate you.
Availability and warranties
We aim to keep PeakTock reliable and secure, but software may contain defects and may not be available without interruption. To the extent permitted by law, PeakTock is provided without additional warranties beyond those expressly stated here. Nothing in these terms excludes statutory guarantees or other rights that cannot lawfully be excluded.
Liability
Nothing in these terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot legally be limited. Otherwise, to the extent permitted by law, Radicio Realis S.L. is not liable for indirect or consequential loss. For business customers, our total liability relating to PeakTock is limited to the amount paid for the licence.
Ending use and changes
You may stop using PeakTock at any time. We may end a licence for a material breach that is not cured after reasonable notice, or immediately where necessary to address fraud, abuse or legal risk. We may update these terms for future use of the service; material changes will be posted here and will not retroactively remove a purchased perpetual licence.
Law and contact
Spanish law governs these terms, without taking away mandatory protections you have under the law of your country of residence. Courts are determined by applicable law; consumers are not required to give up the courts available to them under mandatory consumer rules.
